User Agreement for BESTMIXER Services

1. These 'Terms of Use' apply to the website of BESTMIXER project located at www.BestMixer.net and its Tor-mirror bestac2luiuclefsibhjotzot6ddblyovtt7tddfj7oot5o733ehl7yd.onion.

BY USING THE WEBSITE YOU AGREE TO THE TERMS OF USE. IF YOU DISAGREE WITH THE TERMS DO NOT USE THE WEBSITE.

2. BRIEF digression

Protection of your anonymity is our obligation. This simple phrase is the essence of the partnership between the BestMixer project and the user. For various reasons the most people would like to remain anonymous while using different cryptocurrencies. And we will always do our best to protect this right.

Further, it is necessary to introduce a new term to explain the essence of the service: CAE, or 'Coin Anonymization Event', is the anonymization of various cryptocurrencies. Coins include Bitcoin, Litecoin, Ethereum, Bitcoin Cash - any cryptocurrency that will be involved in BestMixer projects in future. Note that in the BestMixer project coins are not implied as any kind of money are not equated to any state currency and are not an investment tool, in other words, in the BestMixer project coins are just records in the register, hereinafter referred to as Сoins.

If you draw an analogy with the work of any browser that the user uses while navigating the Internet, then BestMixer cleans cookies and history visits in order to third-party programs not bother you with various promotional offers, having information about your personality. BestMixer makes your coins anonymous, unrelated to you as a person thereby helping to solve many issues. More information about purposes of coins anonymization can be found in the Wiki section.

BestMixer does not offer any securities or a collective investment scheme and does not require any kind of registration with or approval from any Monetary Authority. It is recommended to Participants to read this 'Terms of Use' carefully in full, and perform due diligence.

This Agreement has been developed in collaboration with Financial consultants and Legal experts sharing the principles of crypto democracy in the nearest future.

BestMixer platform provides its users with an access to all the advantages of blockchain: security, decentralization, transparency, freedom from financial and geographical restrictions.

BestMixer reserves the right to modify, add or remove clauses of these terms of use at any time in its sole discretion. You are responsible for regularly reviewing these terms of use for any changes. The continued use of the Site following the posting of changes constitutes your binding acceptance of those changes. Subject to your compliance with these terms of use, BestMixer grants you a personal, non-exclusive, non-transferable, limited right to visit and use the site.

3.1 User relationship between you and BestMixer

BestMixer acts as an intermediary to help the users by sending coins to BestMixer's pool to get back anonymously coins, belonged to another user or users, thus to anonymise them.

BestMixer has an independent relationship with the sender and the recipient of the coins. We act on the basis of your intentions and your requests to use our service, which require us to perform tasks on your behalf. You acknowledge that BestMixer is not a Bank, and BestMixer is a CAE service, or 'Coin Anonymisation Event'-service, but not a banking service.

4. By using the service you also agree to the following statements:

4.1. you are:
4.1.1. NOT an individual who is a resident of the United States of America, its territories or possessions, any state of the United States of America or the District of Columbia (the “USA”);
4.1.2. NOT a partnership, corporation or another juridical person formed under the laws of the USA;
4.1.3. NOT a branch, an agency or office located in the USA of a partnership, corporation or another juridical person formed under laws other than those of the USA;
4.1.4. NOT a trust of which any trustee is described in 4.1.1, 4.1.2 or 4.1.3;
4.1.5. NOT a fiduciary or an agent acting on behalf or for the benefit of an individual or entity described in 4.1.1, 4.1.2, 4.1.3, 4.1.4;
4.2. your decision to use BestMixer services was:
4.2.1. NOT based, at least partly, on information you received or communications you exchanged while you, or the person providing the information or with whom the communication was exchanged, was within the USA;
4.2.2. NOT made inside the USA; and
4.2.3. NOT prompted to you from a source within the USA.

5. BestMixer will combine your coins with coins of other users and place those funds into one or more addresses, either in a merged pool.

You allow BestMixer to accept coins on your behalf and send them to the recipient or recipients who, like you, need to anonymise their coins from a joint pool.

By receiving the anonymised coins from BestMixer you assign BestMixer to act as your agent to deposit your coins on your behalf in the joint pool until you receive the anonymised coins back from the pool according to your settings on the transfer delay and split.

6. Commission and donates

6.1. Commissions
The range of miners' commission for confirmation of coins receipt to several addresses participating in the CAE are listed in the Fee section on the website. To improve the quality of the CAE miners' commission for confirmation is floating but within the specified on the website range. The minimum level of the miners' commission is adjusted regularly and automatically and can be changed without prior notice to the user.
For CAE procedure the payment terms of miners' commission specified on the order page are an integral part of this Agreement.

6.2. Donations
By using the BestMixer service, you also agree to the following:

The use of CAE will be possible only after accepting the payment terms of Service fee (hereinafter, Donations), specified on the order page, are integral to this Agreement.
The size of the Donation can be preset during the CAE process. The maximum Donation is not limited to anything other than your wish to support the BestMixer project, but it can not be more than 3%. The minimum Donation is adjusted automatically and can be changed without prior notice to the user.
The Donation is a certain percentage of the total amount and included in the total number of coins you wish to anonymise with the CAE procedure.

7. Release

In case of a dispute you release BestMixer (its employees and employees of joint ventures) from any pretensions, complaints and damages (actual and indirect) of any kind and nature causing or in any way related to such disputes.

8. Service use

It is prohibited to use the BestMixer to receive or send coins identified as used to provide any of the services listed below. The user of the service is responsible for application of the functionality of the BestMixer to provide these services:

8.1.Drugs, and tools specifically intended for the production of drugs, drug paraphernalia, illegal drugs, substances designed to mimic illegal drugs, and/or other psycho active
products (e.g.,K2, salvia divinorum, nitrate inhalers, bath salts, synthetic cannabis, herbal
smoking blends, herbal incense, and HCG/HGH-like substances);
8.2. Products/services specifically offered or intended to be used to create drugs or grow
ingredients for drugs (e.g. 'grow shop' products, seeds for cannabis plants, etc.);
8.3. Pyramid selling;
8.4. Escort agencies / massage parlors / sexual services;
8.5. Timeshare and timeshare maintenance;
8.6. Independent financial advisers (IFA),
Payday loans and insecure loan/lines originating from non FDIC insured banks;
8.7. Counterfeit goods/replicas or those infringing on intellectual property rights, including those designed to infringe on such intellectual property (i.e., knock-offs, imitations, bootlegs);
8.8. Trade of weapons, ammunitions, military arms, explosive devices and firearm parts;
8.9. Products/services that promote hate, violence, discrimination, terrorism, harassment or abuse;
8.10. Products designed to circumvent copyright protection techniques or to otherwise facilitate the unlicensed use of copyrighted materials (e.g. 'mod-chips' to break the encryption of game computers to enable the playing of unlicensed copies of games);
8.11. Providing gambling services in jurisdictions where this is illegal or (where applicable) offering gambling services without a valid license to the relevant jurisdiction;

8.12. Illegal products/services or any service providing peripheral support of illegal activities.
8.13 Adult entertainment, websites & content (such as):
- Adult book stores, video stores, toys;
- Any products on the internet containing graphic or nude content;
Audio (phone sex and adult phone conversations);
Companion/escort services or Dating services (sexually-oriented);
Fetish products;
Membership, clubs, subscriptions;
Prostitution;
Gentleman's clubs, topless bars, and strip clubs;
Video (web-based sexually oriented video)
8.14. Fake references and other services/products that foster deception (including fake IDs and government documents);
8.15. Mail order spouse and international match-making services;
8.16. Social media “click farms” (i.e., the sale of clicks/likes/reviews/endorsements on social
media sites);
8.17. Telemarking companies involved with the following methods of operations:
- Offering a free gift, prize, or sweepstakes/contest entry as an inducement to purchase their product or service
- Inbound telemarketing companies that receive calls as the result of post cards or similar
mailings (as opposed to catalogue or media advertising);
- Selling products/services as an agent for a third party;
8.18 Merchants engaged in any form of deceptive marketing practise including but not limited to:
- Hidden Disclosure'
- Bogus claims & endorsements;
- Pre-checked opt in boxes;
- Refund/Cancellation avoidance;
- Poorly disclosed negative options;
- Merchants offering substantial rebates or special incentives (e.g., free gift, prize,
sweepstakes, or contest) as an inducement to purchase products/services;
- Negative response marketing techniques by any type of merchant (i.e., customer is
automatically charged if they don't return the merchandise at the end of a free trial period);
8.19. Jammers or devices that are designed to block, jam or interfere with cellular and personal communication devise/signals (e.g., GPS);
8.20. Decryption and descrambler products including mod chips, spy devises / services / software.

And any other services that violate the Terms of use of the BestMixer service.

9. If you use the BestMixer service in violation of this Agreement and the Terms of Use, including all categories described above, you are fully responsible for your actions and obligations imposed on the BestMixer project by a third party due to your violation of this Agreement.

10. The headings used in this Agreement are intended for reference purposes only and do not limit, interpret, define or describe the scope and meaning of each section.

BestMixer DOES NOT MAKE ANY PROMISE CONCERNING THAT THE WEBSITE OR ANY CONTENT, FEATURE OR SERVICE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE AND THAT ANY deficiencies WILL BE IMPROVED, OR THAT YOUR USE OF THE SITE WILL LEAD TO CERTAIN consequences. THE WEBSITE AND ITS CONTENTS ARE SUPPLIED "AS IS" AND "AS AVAILABLE” BASIS. ANY INFORMATION ON THE SITE MAY BE CHANGED WITHOUT NOTICE. BestMixer DOES NOT GIVE ENSURE THAT ANY FILES OR OTHER DATA DOWNLOADED FROM THE SITE DO NOT CONTAIN VIRUS OR harmful FUNCTIONS.

BestMixer REFUSES ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR ANY SPECIFIC USE. BestMixer REFUSES ANY LIABILITY FOR THE ACTS, OMISSIONS AND CONDUCT OF ANY THIRD PARTIES IN CONNECTION WITH YOUR USE OF THE WEBSITE AND/OR ANY BestMixer SERVICES, YOU accept ALL RESPONSIBILITY FOR YOUR USE OF THE SITE AND ANY LINKED SITES.
YOUR ONLY REMEDY AGAINST BestMixer FOR discontent WITH THE SITE OR ANY CONTENT IS discontinuance OF THE SITE USING OR SUCH CONTENT. THIS LIMITATION OF REMEDIES IS A PART OF THE AGREEMENT.
